Alina Habba has resigned as New Jersey's top federal prosecutor. This decision was prompted by a judicial decision that challenged her right to occupy the role.

Official Departure

The head of the Justice Department, Pam Bondi, confirmed Habba's resignation on Monday. She commented that the appeals court finding made it "untenable" for Habba to lead the department effectively.

"Do not interpret adherence to the ruling as defeat," she declared. "The effort will now reach across the nation."

Court Ruling

Habba's exit was triggered by a judicial panel determined that she had been serving in violation of the law as the federal prosecutor. This decision is expected to impact many criminal cases in the Garden State.

The judicial panel declared that a temporary posting that did not receive the advice and consent of the Senate violated the statute on vacant positions.

Next Steps and Responses

Bondi said that Habba will continue working within the Department of Justice as a senior adviser. She will pursue additional appeals of the disqualification, in the hope of achieving a reversal.

On a social media platform, she wrote that the judiciary "must not countermand the executive's selection of attorneys tasked with executing the primary duty of the administration of enforcing the law."

Performance in Office

Bondi praised her tenure and noted that while she was in charge, the Newark saw a significant drop in offenses. She also stated that the Camden experienced its initial homicide-free summer since 1974 with no murders.

Connection to Donald Trump

Habba, 41, was initially recruited to the former president's legal defense in 2021. She later acted for the former president in his business records case in 2024, when he was conviction on 34 counts of document fraud.

Prior to her appointment to the role of US Attorney, the former president had revealed he was naming her as his presidential counsellor in a potential future term, calling the lawyer as deeply loyal and a relentless legal advocate.
